Article 1 – Definitions

Article 3 – Applicability

By placing an order, the customer agrees to these Terms.

All offers are subject to availability and may be withdrawn or amended at any time.

Product descriptions, images, and specifications are provided for informational purposes. Slight variations may occur due to screen settings, manufacturing variations, or product updates.

Prices are displayed in pounds sterling and include VAT where applicable, as stated at checkout.

Shipping fees and any additional costs are clearly communicated before checkout.

Article 5 – Formation of the Contract

The contract is concluded once the customer completes checkout and payment is successfully processed.

An order confirmation will be sent by email.

We reserve the right to refuse, cancel, or limit orders in cases of suspected fraud, stock errors, pricing mistakes, or other legitimate business reasons.

Article 6 – Returns & Refunds

Returns, exchanges, and refunds are governed by our Returns & Refunds Policy as published on our website.

If a product arrives damaged, defective, or incorrect, please contact us promptly at support@nancyandwren.co.uk with your order number and clear photos of the issue.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

Article 7 – Shipping & Delivery

Estimated delivery times are provided for convenience only and are not guaranteed unless expressly stated otherwise.

We will ship orders within the timeframe stated at checkout or in our Shipping Policy. If no shipping timeframe is stated, orders will be shipped within 30 days of purchase unless a longer period is agreed. If we cannot ship on time, we will notify you and, where required by law, offer the option to consent to the delay or cancel for a refund.

Customers are responsible for providing accurate shipping details.

Risk of loss or damage passes to the customer upon delivery to the shipping address provided, to the extent permitted by law.

Article 8 – Customs, Import Duties & Taxes

For orders shipped outside the United Kingdom, import duties, taxes, customs clearance fees, and similar charges may apply.

Unless otherwise stated, such charges are the responsibility of the customer.

We are not responsible for delays caused by customs processes or for additional charges imposed by local authorities.

Article 9 – Warranty & Product Conformity

We aim to provide products that match their description and arrive in acceptable condition, in line with the Consumer Rights Act 2015.

This does not cover normal wear and tear, accidental damage, misuse, improper storage, or improper handling.

If you believe there is a problem with your item, please contact us within a reasonable time after discovering the issue.

Article 10 – Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the amount paid for the product giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential damages, except where such limitation is prohibited by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under UK law.

Payments are processed via secure third-party payment providers.

We do not store full payment card details on our own servers.

We reserve the right to refuse or cancel transactions where fraud or unauthorised activity is suspected.

Any disputes arising out of or relating to these Terms shall be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law provides otherwise.
